Basic Requirements of a Foreign Divorce Agreement
The Civil Affairs Department of China has differing requirements for divorce agreements. 1. Basic information of both parties including name, sex, age, address, and etc.
2. The reason for divorce between husband and wife. For example, it can be described as “the voluntary divorce between both parties. This agreement is what has been agreed upon following a mutual consensus.”
3. The custody rights to children (if applicable). The agreement will express custody of children, alimony payments, and visitation of children.
4. How to split the couple’s mutual property and allocate mutual debt if there is any.
5. The two parties agreement to uphold the agreement. A statement such as “Both parties guarantee to uphold all matters within this agreement upon implementation.”
